DENNIS VANCE MILNER [#113464], 48, of Dublin was revoked, the previous stay of suspension was lifted and he was placed on three years of probation with a one-year actual suspension. He also was ordered to comply with rule 955. The order took effect March 19, 2006.

Milner violated terms of the probation imposed in a 2004 disciplinary order that revoked an earlier probation. He failed to make restitution to a client or submit three quarterly probation reports.

In the original case, Milner stipulated that he failed to perform legal services competently or comply with the terms of an agreement in lieu of discipline he reached with the State Bar in 2001. Milner also was disciplined last year for practicing law while on involuntary inactive status for not paying bar dues or complying with MCLE regulations.

September 22, 2005

DENNIS VANCE MILNER [#113464], 47, of Dublin was suspended for one year, stayed, placed on two years of probation with a 90-day actual suspension, and was ordered to comply with rule 955. The order took effect Sept. 22, 2005.

Milner stipulated that he practiced while suspended for failing to pay bar dues or comply with MCLE requirements. He represented a client who made an insurance claim.

Milner also was disciplined in 2003 for misconduct in two matters — he failed to perform legal services competently and he did not comply with conditions attached to an agreement in lieu of discipline he reached with the bar in 2001.

In 2004, his probation was revoked because he failed to make restitution.

In mitigation, Milner has emotional or physical difficulties.

October 10, 2004

DENNIS VANCE MILNER [#113464], 46, of Dublin Probation was revoked, the stay of suspension lifted, and he was actually suspended for 30 days, placed on three years of probation and was ordered to make restitution. The order took effect Oct. 10, 2004.

Milner was disciplined in 2003 but failed to make the required restitution of $2,000.

The discipline was imposed for failure to comply with conditions attached to an agreement in lieu of discipline Milner reached with the bar in 2001. At the same time, he stipulated that he failed to respond to requests for information.

August 31, 2003

DENNIS VANCE MILNER [#113464], 45, of Dublin was suspended for one year, stayed, placed on three years of probation and was ordered to take the MPRE within one year and make restitution. The order took effect Aug. 31, 2003.

Milner stipulated to misconduct in two cases.

One client hired him for several purposes: to help close escrow and distribute the sales proceeds of his home and to complete a bankruptcy for the client's company. A previous attorney had a conflict with the bank in question.

Once escrow closed, the title company gave three checks to Milner, one for the IRS, one for the State of California, both intended to pay the company's taxes, and one for Milner's trust account. About $2,200 from the trust account money was for Milner's legal fees.

The client hired a new lawyer to conclude matters with respect to the sale of his company, but Milner did not respond to four requests for information about the bankruptcy and the distribution of escrow funds.

Although Milner took action to distribute the escrow funds and began preparation of some bankruptcy materials, he abruptly relocated his office and neither the client nor the new attorney were able to communicate with him.

In the second matter, Milner did not comply with conditions attached to an agreement in lieu of discipline he reached with the bar in 2001. He did not attend ethics school, file a quarterly report or complete a fee arbitration.

In mitigation, Milner has no prior record of discipline and he had financial problems.
