BERNARD PAUL KENNEALLY [#113160], 43, of Los Angeles was suspended for two years, stayed, placed on two years of probation with a nine-month actual suspension, and was ordered to take the MPRE within one year and comply with rule 955. The order took effect June 12, 1998.

After a default hearing, the State Bar Court found that Kenneally committed misconduct in five client matters, four involving his failure to handle tax cases. He failed to perform legal services competently, communicate with his clients, return financial records or refund unearned fees.

Several clients were assessed tax penalties by the IRS and some had their wages garnished.

In one matter, Kenneally never followed through on a retrial or made any attempt to collect a judgment.

In 1996, the San Francisco Superior Court assumed jurisdiction over Kenneally's practice after he apparently filed bankruptcy and deserted his law office, leaving 40 to 60 boxes of client files in storage. He was enrolled as an inactive member of the bar in 1997.

Other than 11 years of discipline-free practice, there was no mitigation.
