September 20, 2009

NUJYA A. STRAWDER [#112402], 52, of Anaheim Probation was revoked, the previous stay of suspension was lifted and she was suspended for three years and must prove her rehabilitation. Credit is given for a period of involuntary inactive enrollment that began Feb. 22, 2009. The order took effect Sept. 20, 2009.

Strawder failed to comply with probation conditions attached to a 2005 disciplinary order: she submitted seven probation reports late and did not make required restitution payments, even after the requirement was modified.

The underlying discipline was imposed for charging an unconscionable fee, failing to pay court-ordered sanctions, perform legal services competently, deposit client funds in a trust account or communicate with a client, and for committing an act of moral turpitude. She also did not comply with probation conditions — she did not make nine restitution payments — attached to a 2001 probation revocation.

In that matter, she failed to file three quarterly reports or attend ethics school.

Strawder was first disciplined in 1997 for 19 counts of misconduct, including failure to perform legal services competently, return unearned fees, deposit and maintain advanced costs in a client trust account, properly maintain records of client funds, respond to clients’ case status inquiries or keep clients informed.

She did not pay court-ordered sanctions, did not maintain the respect due to the courts by not appearing at numerous hearings, charged an unconscionable fee, collected an illegal fee in a probate case and misappropriated more than $15,000 from a client’s estate.

Many of her actions constituted moral turpitude.

May 28, 2005

NUJYA STRAWDER [#112402], 47, of Anaheim was suspended for three years, stayed, placed on five years of probation with an actual one-year suspension and was ordered to prove her rehabilitation, take the MPRE and comply with rule 955. The order took effect May 28, 2005.

Strawder stipulated that she failed to comply with probation conditions attached to a discipline originally imposed in 1998. The probation was revoked and a new probation was imposed, including requirements that she make restitution to an estate. She missed nine payments.

The underlying discipline was imposed for charging an unconscionable fee, failing to pay court-ordered sanctions, perform legal services competently, deposit client funds in a trust account or communicate with a client, and for committing an act of moral turpitude.

In mitigation, Strawder has serious financial problems. She has not had steady employment since 1999 and she supports herself and three children.

July 21, 2001

The probation of NUJYA A. STRAWDER [#112402], 43, of Anaheim was revoked, the previous stay of suspension was lifted and she was actually suspended for 60 days and placed on four years of probation. The order took effect July 21, 2001.

Strawder failed to comply with probation conditions attached to a 1998 discipline: she did not file three quarterly probation reports on time or attend ethics school or client trust accounting school.

The discipline was imposed for charging an unconscionable fee, failing to pay court-ordered sanctions, perform legal services competently, deposit client funds in a trust account or communicate with a client, and for committing an act of moral turpitude.

In mitigation, she had serious family, emotional and financial problems stemming from a nasty divorce and child custody dispute and wound up living in her car and various hotels. She also had pneumonia. Her problems made it extremely difficult to meet her probation requirements.

Strawder stipulated to multiple acts of misconduct in 11 different client matters. They included failure to perform legal services competently, return unearned fees, deposit and maintain advanced costs in a client trust account, properly maintain records of client funds, respond to clients’ case status inquiries, or keep clients informed.

She did not pay court-ordered sanctions, did not maintain the respect due to the courts by not appearing at numerous hearings, charged an unconscionable fee, collected an illegal fee in a probate case, and misappropriated more than $15,000 from a client’s estate.

Many of her actions constituted moral turpitude.

In mitigation, Strawder practiced for many years without discipline, was involved in a nasty divorce and child custody battle with an abusive husband, and sought and received counseling for three years.
