January 7, 2001

LAWRENCE MASON KELLY [#111218], 66, of Etna was suspended for 30 days, stayed, and placed on one year of probation. The probation is to run consecutive to a 2000 probation for a total of three years. The order took effect Jan. 7, 2001.

Kelly was ordered to comply with rule 955 as part of the 2000 discipline order, but filed the required affidavit eight days late.

Kelly has a record of five prior disciplines.

In mitigation, the late filing did not result in harm and he cooperated with the bar’s investigation.

March 24, 2000

LAWRENCE MASON KELLY [#111218], 65, of Etna was suspended for two years, stayed, placed on two years of probation with a six-month actual suspension, and was ordered to prove his rehabilitation, take the MPRE within one year and comply with rule 955. The order took effect March 24, 2000.

Kelly was suspended from practice in 1997, and among other probation conditions, he was required to comply with rule 955 by notifying clients, opposing counsel and other pertinent parties of his suspension. He filed an affidavit with the Supreme Court swearing that he had done so.

However, at the time of his suspension, he was attorney of record in a case pending in Siskiyou Superior Court. He did not notify the court or opposing counsel of his suspension.

The parties stipulated that despite his conduct, there was no finding of bad faith.

Kelly has been disciplined four times previously — in 1992, twice in 1994, and again in 1997 — for offenses ranging from failing to respond to clients’ inquiries to failing to act competently to failing to comply with probation conditions.

In mitigation, he cooperated with the bar’s investigation and he mistakenly believed the Siskiyou matter was not pending and that notification was not required by rule 955.

December 17, 1997

LAWRENCE MASON KELLY [#111218], 62, of Etna was suspended for one year, stayed, placed on two years of probation with a 90-day actual suspension and until he makes restitution, and was ordered to take the MPRE within one year and comply with rule 955. The order took effect Dec. 17, 1997.

Hired to handle a breach of contract suit, Kelly failed to bring the case to trial within the required five years and it was dismissed. His client won a $39,000 malpractice judgment against Kelly, who did not participate.

Kelly did not pay the judgment or refund the client’s original $1,000 fee.

He has been disciplined twice previously for failing to communicate with clients or competently perform legal services, for filing a false declaration and for serving as a certified public accountant when his license was expired.

In mitigation, he cooperated with the bar’s investigation.
