EUGENIO PEGUERO JR.[#109822], 43, of Huntington Park was disbarred July 9, 2000, and was ordered to comply with rule 955 of the California Rules of Court.

The State Bar Court found that in three personal injury matters, Peguero did not pay his clients’ medical bills after settling the cases. He misappropriated client funds, an act of moral turpitude, did not return his clients’ phone calls or respond to their letters and failed to cooperate with the bar’s investigation.

In addition, he did not comply with conditions attached to a 1997 discipline; he did not submit quarterly reports, an office organization plan, or proof of attendance at ethics school, and he did not make restitution. That discipline resulted from Peguero’s failure to promptly respond to client inquiries or to return client files.

Judge Madge S. Watai recommended Peguero’s disbarment, noting his “grossly negligent wilful misappropriation” of more than $3,700 in client funds, his “complete disregard” for the welfare of several clients and his non-compliance with probation conditions he had agreed to meet.

March 13, 1997

EUGENIO PEGUERO JR. [#109822], 39, of Huntington Park was suspended for one year, stayed, placed on two years of probation with conditions including restitution, and was ordered to take the MPRE within one year. The order took effect March 13, 1997.

Peguero failed to complete legal services competently for co-plaintiffs in a personal injury case, nor did he communicate with his clients, keep them informed of significant developments in their case, or forward their file to a new attorney as requested. As a result of Peguero's inaction, one client's default was entered in a cross-complaint, sanctions were imposed for failure to cooperate with discovery, the complaint was stricken, and the case was dismissed for failure to serve the summons and complaint.

The complaint against the co-defendant was also dismissed. Peguero's secretary misinformed one of the plaintiffs that his case was still pending, when in fact the case had been dismissed. The client did not learn of the dismissal until he reviewed his file at the courthouse.

In mitigation, Peguero suffered extreme financial difficulties, two deaths in his family, and physical problems. He had no record of discipline since his 1983 admission to the bar.
