JOHN CARMEL NOTTI [#109728], 58, of Los Angeles was suspended for two years, stayed, placed on three years of probation and was ordered to prove his rehabilitation. The order took effect Sept. 2, 2007.

Notti successfully completed the State Bar’s Alternative Discipline Program following convictions for assault with a deadly weapon (a car), making criminal threats and resisting arrest. He was placed on interim suspension in 2004, and was subsequently admitted to the Lawyer Assistance Program for attorneys with substance abuse or mental health problems. At that time, the interim suspension was vacated.

Last year, the Los Angeles Superior Court reduced the felony convictions to misdemeanors, Notti’s guilty plea was set aside, a plea of not guilty was entered and the complaint against him was dismissed. He also passed the MPRE.

The underlying conviction stemmed from a dangerous freeway altercation between Notti and another driver. When the police came to his home, he resisted arrest. Originally charged with seven felonies, he entered into a plea agreement. Notti had a previous misdemeanor conviction for alcohol-related reckless driving.

In mitigation, he practiced without discipline for 20 years before the incident, he cooperated with the bar’s investigation and he has dealt with his alcohol problem.
