KEVIN JOHN MIRCH, 54, of San Diego was suspended for two years, stayed, placed on two years of probation with a six-month actual suspension and was ordered to take the MPRE within one year and comply with rule 9.20 of the California Rules of Court. The order took effect Oct. 9, 2011.

Mirch stipulated that discipline imposed on him in Nevada warranted discipline in California for maintaining an unjust action, accepting employment for the purpose of harassing or injuring someone and for misleading the court.

Mirch filed a lawsuit in 2004 that made a series of false allegations against the defendants, including a scheme to commit bankruptcy fraud and charges that another attorney threatened reprisals against him, instructed his clients not to pay his fees and destroyed documents proving that he was entitled to receive a fee in excess of $1 million. He admitted in the stipulation that he intended to “harass, embarrass and otherwise injure and inconvenience” the defendants and that he “refused to accept responsibility for anything that was done in connection with the underlying litigation.”

The stipulation also indicates that he “pursued frivolous and unfounded theories of recovery” in the lawsuit.

Mirch was privately reproved in 1988. In mitigation, he cooperated with the bar’s investigation.
