CARLA RUTH MCBEATH [#106047], 64, of Fort Lee, N.J., was disbarred Aug. 6, 2015 and ordered to comply with rule 9.20 of the California Rules of Court.

The State Bar Court found McBeath culpable of violating rule 9.20 by not filing her compliance affidavit on time. In mitigation, her actions did not cause any client harm.

McBeath had two prior records of discipline. In 2012, she was suspended for not complying with the terms of her disciplinary probation by filing two quarterly probation reports late and missing another entirely, not submitting proof that she completed MCLE courses by the extended deadline and filing proof of restitution payments late or not at all. She was previously suspended in 2010 for failing to perform legal services with competence, keep a client reasonably informed of significant developments or refund an unearned fee in a single client matter.

November 30, 2012

The probation of CARLA RUTH McBEATH [#106047], 61, of Fort Lee, N.J., was revoked, the previous stay of suspension was lifted, she was placed on three years of probation and suspended for one year and until she makes restitution. If the suspension exceeds two years, she must prove her rehabilitation. She also was ordered to comply with rule 9.20 of the California Rules of Court. The order took effect Nov. 30, 2012.

McBeath was disciplined in 2010 after stipulating that in a single client matter, she failed to perform legal services with competence, keep a client reasonably informed of significant developments and refund an unearned fee. Although she communicated regularly with her probation monitor and received extra time to complete continuing education requirements and a deferral of a restitution payment, she did not comply with other probation conditions. She filed two quarterly probation reports late and missed another entirely, did not submit proof that she completed MCLE courses by the extended deadline, and filed proof of restitution payments late or not at all.

October 15, 2010

CARLA RUTH McBEATH [#106047], 59, of Fort Lee, N.J., was suspended for one year, stayed, placed on three years of probation and was ordered to take the MPRE within one year. The order took effect Oct. 15, 2010.

McBeath, who was a partner at a New York law firm but practiced immigration law based on her admission in California, stipulated to three counts of misconduct in an immigration matter before an appellate court where she was not admitted. She intended to seek admission to the appellate court through sponsorship of one of her law partners.

McBeath prepared a petition for review for a client, signed by a law partner, and submitted it to the appellate court. When she later left the firm, she offered to continue to represent the client for $3,000. She never became his attorney of record, never filed the brief and the client’s appeal was dismissed. The client paid her $2,600.

McBeath stipulated that she failed to perform legal services competently, refund her client’s unearned fee or keep him reasonably informed about developments in his case.

In mitigation, she cooperated with the bar’s investigation and she had severe financial problems at the time of the misconduct.
