FREDERICK WILLARD SMITH, JR. [#104913], 60, of Oakdale was suspended for one year, stayed, placed on two years’ probation and ordered to take the MPRE. The order took effect March 8, 2014.

Smith stipulated that in 2004 he entered into a $250,000 loan with a client when the transaction and terms were not fair to her, did not disclose and transmit in writing the terms of the transaction, and did not obtain the client’s written consent or give her time to seek independent counsel.

When the client passed away in December 2010, he had not paid the principal amount of the $250,000 back and the woman’s nieces and co-beneficiaries filed a civil suit against him. In May 2012, he sent a proposed settlement agreement to the plaintiffs’ attorney containing a requirement that the plaintiff not file a complaint with the State Bar against him.

In mitigation Smith had no prior record of discipline in 30 years of practicing law and entered into a prefiling stipulation with the State Bar.
