WARREN PAUL FELGER [#104410], 58, of Fresno, was disbarred May 29, 2015 and ordered to comply with rule 9.20 of the California Rules of Court.

A State Bar Court hearing judge recommended Felger be disbarred, finding he twice used dishonest tactics to collect fees, willfully misappropriated $4,065.94 and obtained a fraudulent default judgment against a former client. Felger appealed, denying the misappropriation, but the State Bar Court Review Department affirmed the judge’s findings and disbarment recommendation.

In one matter, Felger misappropriated his client’s bankruptcy distributions totaling $4,065.94 by depositing them into his general account after he promised his client he would maintain them in trust until their fee dispute was resolved.

Felger obtained the fraudulent default judgment against Central Green Mutual Water Company, his former client, by serving a lawsuit for his legal fees on himself on behalf of his former client, but without the client’s knowledge or consent. Felger had been fired by the company but was still listed as its agent for service of process. When he filed a complaint to recover unpaid legal fees in excess of $25,000, he served it on himself and did not serve the company. He then served two additional notices on himself: a request for entry of default and clerk’s default judgment for $35,880.30 and the court’s notice of entry of default judgment in his favor.

In mitigation, Felger had no prior record of discipline in 25 years of practicing law.
