BRICE EUGENE BENNETT [#104223], 54, of San Jose was disbarred Dec. 4, 2004, and was ordered to comply with rule 955.

In a default proceeding, the State Bar Court concluded that Bennett did not comply with rule 955, as required by a 2003 disciplinary order. He did not file with the Supreme Court an affidavit stating that he notified all clients, opposing counsel and other interested parties of his suspension.

The underlying discipline also was imposed as part of a default proceeding; in one client matter, Bennett failed to perform legal services competently, communicate with his client or cooperate with the bar’s investigation and he improperly withdrew from a case. He also was disciplined in 1991, following felony convictions for failing to pay payroll deductions and state income taxes.

BRICE EUGENE BENNETT [104223], 52, of San Jose was suspended for one year, stayed, actually suspended for 90 days and until the State Bar Court grants a motion to terminate the actual suspension, and was ordered to take the MPRE and comply with rule 955. If the actual suspension exceeds two years, he must prove his rehabilitation. The order took effect Aug. 31, 2003.

In a default proceeding, the bar court found that Bennett failed to perform legal services competently, communicate with a client or cooperate with the bar's investigation, and he improperly withdrew from employment.

In a personal injury case, he did not respond to repeated phone messages and letters from an insurance company and later from his client. The two final letters from the client, demanding a return of his file, were returned as undeliverable.

Bennett was disciplined in 1986 after a conviction for tax violations and for his failure to maintain funds in a client trust account.
