MICHAEL THOMAS DELL’OSSO [#103439], 54, of Tracy was disbarred March 6, 2008, and was ordered to make restitution and comply with rule 9.20 of the California Rules of Court.

In a default proceeding, the State Bar Court found that Dell’Osso, who has been disciplined four times previously, failed to return unearned fees, keep his address current with the bar or comply with rule 955, since renumbered as rule 9.20.

He was suspended in 2006 and was ordered to notify his clients, opposing counsel and other pertinent parties that he lost his license. He did not file an affidavit to that effect with the bar court. Failure to comply with rule 955 is grounds for disbarment.

A client who was considering divorcing her husband gave Dell’Osso a $2,000 fee for future services, but when she and her husband reconciled, she requested a refund. Her letter was returned as not deliverable, although Dell’Osso eventually received it. He did not, however, refund the client’s advance fee.

Judge Pat McElroy recommended Dell’Osso’s disbarment in view of “the serious and unexplained nature of (his) misconduct, the lack of participation in these proceedings, the lack of any mitigating factors, the existence of a prior disciplinary record and (Dell’Osso’s) repeated failure to comply with orders of the California Supreme Court.”

Dell’Osso was privately reproved in 2003 for failing to respond to clients’ reasonable status inquiries, keep a client informed of developments in a case, refund unearned fees or cooperate with the bar’s investigation.

When he did not comply with probation conditions, he was publicly reproved two years later.

In the matter underlying the disbarment case, Dell’Osso was suspended in 2006 for practicing when not entitled and for not responding to his client’s status inquiries. Later the same year, he was suspended again for failing to comply with conditions attached to the 2005 public reproval.

“Lesser discipline than disbarment is not warranted,” McElroy wrote.

December 15, 2006

MICHAEL THOMAS DELL’OSSO [#103439], 53, of Tracy was suspended for two years, stayed, actually suspended for one year and was ordered to take the MPRE and comply with rule 955. If the actual suspension exceeds two years, he must prove his rehabilitation. The order took effect Dec. 15, 2006.

In a default proceeding, the State Bar Court found that Dell’Osso violated conditions attached to a 2005 public reproval — he did not file five quarterly reports or provide proof that he passed the MPRE or attended ethics school.

The discipline was imposed for Dell’Osso’s failure to comply with conditions attached to a 2003 private reproval. In that matter, he failed to respond to client inquiries in two matters, keep a client informed of developments in a case, refund an unearned fee or cooperate with the bar’s investigation.

He also was disciplined in 2006 for the unauthorized practice of law and for not responding to his client’s status inquiries.

February 19, 2006

MICHAEL DELL’OSSO [#103439], 52, of Tracy was suspended for two years, stayed, placed on two years of probation with a six-month actual suspension and was ordered to prove his rehabilitation and comply with rule 955. The order took effect Feb. 19, 2006.

Dell’Osso stipulated to two counts of misconduct in two matters.

In a marital dissolution, he did not respond to his client’s letters and phone calls concerning the status of his case. When the client received an invoice for $1,865, he asked for a status update but received nothing.

In the second matter, Dell’Osso was placed on involuntary inactive status after he failed to pay a fee arbitration award of $350 plus a $500 penalty. While he was inactive, he appeared in court at least 14 times. Dell’Osso said he did not know that his status was changed.

He stipulated that he failed to respond to a client’s inquiries about his case and he practiced law while not entitled.

Dell’Osso also was disciplined in 2003 with a private reproval and in 2005 with a public reproval for failing to comply with probation conditions.

In mitigation, he cooperated with the bar’s investigation.
