July 8, 1998 JEFFREY JOSEPH SLOANE [#103245], 42, of San Jose was disbarred July 8, 1998, and ordered to comply with rule 955. In a default proceeding, Sloane was found by the State Bar Court to have committed multiple acts of wrongdoing over a significant time period. He also had a lengthy record of prior discipline.Sloane was placed on probation in separate matters in 1994 and 1995, with conditions including restitution to a client, quarterly probation reports and quarterly reports from a treating physician or psychiatrist. He did not submit any of the reports, nor did he make restitution.In another matter, Sloane represented a client in both a criminal and one or more civil matters. In asking for a continuance in the criminal case, he represented to the court that he would be available to handle the matter at a time when he knew he would be suspended. He also withdrew from representation without refunding the unearned portion of the client's advanced fees.Sloane also was charged with several other violations by the State Bar, but the court found they were not proven.However, the court noted that in addition to the new matter and Sloane's two earlier disciplines, he was disciplined in 1991 after stipulating to failure to communicate with two clients, competently perform legal services for one client, or cooperate with the bar's investigation. The stipulation identified as mitigation an array of matters relating to Sloane's mental and physical health, as well as the very serious illness of his daughter.In recommending disbarment, the bar court expressed sympathy for Sloane as an individual, noting that "the last few years have been an ordeal for him." However, his failure to make restitution, acknowledge his wrongdoing or otherwise try to mitigate damage to his clients required severe action."Given the seriousness of his misconduct, some of which followed his most recent imposition of discipline, and his lack of participation in these proceedings, [Sloane] leaves the court no realistic alternative but to recommend his disbarment," the court wrote.November 3, 1995 JEFFREY JOSEPH SLOANE [#103245], 39, of San Jose was suspended for five years, stayed, given an actual suspension of 18 months, and ordered to make restitution and prove rehabilitation, fitness to practice and learning and ability in the law. When he returns to active status, he will be on probation for three years. Sloane also was ordered to take the CPRE within one year and to comply with Rule 955. The order took effect Nov. 3, 1995. Sloane failed to perform legal services in three matters, failed to communicate with his clients in two, and misrepresented the status of one case. In a divorce case in which time was of the essence for his client, Sloane told her that a variety of court dates were set and then continued. In fact, the case had been dropped from the calendar because Sloane had done no work on it. He was fired by another client in a divorce matter but never refunded her fees. In a third case, as a result of his failure to notify his client and appear at scheduled depositions, a bench warrant was issued for his client's arrest. The court ultimately found she was abandoned by Sloane. Sloane has been disciplined twice before for failure to communicate or perform competently. In mitigation, he suffers from depression and has undergone five operations since 1992. |
