June 17, 2016 JULIA PATRICIA GIBBS [#102072], 59, of Sacramento, was suspended from the practice of law for six months and placed on probation for two years. She must pass the MPRE. The order took effect June 17, 2016. Gibbs stipulated that she failed to provide legal services to a client and failed to file a bankruptcy petition on the client’s behalf. She also failed to communicate with the client, return fees or comply with the conditions of a prior disciplinary probation.In aggravation, Gibbs had previously received a one-year stayed suspension for professional misconduct and was placed on probation for two years. Gibbs never provided a copy of the claim to her client, did not file a motion for relief from a stay and did no further work. She did not reply to his emails or phone calls. The client had paid fees of $1,500. She stipulated that she failed to perform legal services competently, respond to her client’s status inquiries, refund unearned fees or cooperate with the bar’s investigation.In a second matter, she was hired by a retirement plan company that was pursuing a foreclosure. She performed no services of value and didn’t respond to her client’s emails. She stipulated that she failed to perform legal services competently, respond to her client’s status inquiries or refund unearned fees.In mitigation, Gibbs had no prior discipline record, cooperated with the bar’s investigation and demonstrated remorse. |
