STANFORD YING KIT LAU [#100994], 45, of West Hills was disbarred Aug. 26, 2000, and was ordered to comply with rule 955 of the California Rules of Court.

Lau failed to comply with probation conditions attached to a 1998 disciplinary order requiring him to make restitution and attend MCLE classes in ethics and law office management, and he moved without notifying the State Bar.

He has three prior disciplines, “two of which are extremely serious,” wrote State Bar Court Judge Nancy Roberts Lonsdale.

He was publicly reproved in 1989 for failing to cooperate with a bar investigation.

In 1994, he was disciplined for multiple acts of professional misconduct, including conflicts of interest, mishandling client matters and trust account violations. When he did not comply with his probation conditions, he was again disciplined in 1998; further trust account improprieties and another failure to cooperate with the bar’s investigation also were charged.

“Where there are two prior records of discipline, disbarment is the appropriate sanction, unless the most compelling mitigating circumstances clearly predominate,” Lonsdale wrote. Because there was no showing of mitigation, she recommended Lau’s disbarment.

STANFORD Y.K. LAU [#100994], 42, of Malibu was suspended for two years, stayed, and placed on probation for two years with an actual suspension of 90 days, effective May 20, 1998. He was ordered to comply with rule 955.

In a divorce matter, Lau failed to provide an accounting of attorney's fees as requested by a client. In addition, he failed to cooperate with bar investigators seeking pertinent documents related to the matter.

In a probation violation matter, Lau neglected to file a timely probation report and a statement indicating whether or not he was in possession of client funds.

In aggravation, Lau has a prior record of discipline. He received a public reproval in 1989 and a six-month actual suspension in 1995.

Also considered as aggravating circumstances were his failure to cooperate with the bar's investigation, evidence of multiple acts of wrongdoing and the similarity of his current misconduct to his prior record.

While not accepted as mitigating circumstances, it was agreed that certain physical and family problems encountered by Lau could be considered by the court. Specifically, back and neck injuries from a 1987 bicycle accident resulted in chronic pain and a 1993 diagnosis of sleep apnea affected Lau's work performance.

In addition, Lau's marriage began to dissolve and a stressful child custody battle ensued. Lau was the primary caretaker of one of his children who underwent 14 surgeries and required 24-hour monitoring.

Since 1994, Lau has been active in several State Bar practice sections and local bar associations. He has performed substantial pro bono legal services in the area of family law.

Although he disputed that any fees paid by the client in the divorce matter were unearned, he agreed to pay the client for any inconveniences he may have experienced.
