JON STEVEN KOTTKE [#100968], 50, of Costa Mesa was suspended for two years, stayed, actually suspended for 30 days and until the State Bar Court grants a motion to terminate the suspension, and he was ordered to take the MPRE within one year. If the actual suspension exceeds 90 days, he must comply with rule 955; if it exceeds two years, he must prove his rehabilitation. The order took effect May 8, 2005.

In a default matter, the bar court found that Kottke committed three acts of misconduct in representing a client in a civil action for securities fraud. Kottke filed a lawsuit in federal court, but it was defective because it omitted the key defendant who had sold the stock to his client. The case was transferred from California to Florida.

Kottke hired local counsel in Miami to represent his client and also filed a request to appear pro hac vice.

Several pleading disputes arose, based mainly on Kottke’s failure to plead the material facts clearly. He filed three amended complaints without telling the client, nor did he notify the client when the entire case was dismissed.

The court found that Kottke failed to perform legal services competently, respond to client inquiries or cooperate with the bar’s investigation.

He has no record of discipline since his 1981 admission to the bar.
