TIMOTHY R. GELEGAN [#100773], 55, of Fresno was disbarred March 12, 2009, and was ordered to comply with rule 9.20 of the California Rules of Court.

Gelegan stipulated that he committed 12 acts of misconduct and misappropriated more than $180,000 from seven clients. The balance in his client trust account fell to zero several times.

He received a $60,000 check on his client’s behalf from an insurance company. The client was entitled to $48,000, but Gelegan never gave him any money. Gelegan later represented the same client’s son, who had been arrested. A bail bondsman placed a lien on the son’s home, obtaining $60,000. After the son’s criminal trial, Gelegan asked that the funds be returned; the bail bondsman returned $60,619.34, payable to the son. Gelegan deposited the check in his client trust account, but never returned the money to his client or the son.

In a second matter, Gelegan settled a personal injury case for $15,000 and deposited the settlement check in his trust account. He never provided any funds to his client, who was entitled to at least $8,500. The Client Security Fund paid the client $10,000 as a result of Gelegan’s actions.

In another personal injury matter, Gelegan received a check for $46,000 on behalf of two clients. They were entitled to $27,600, less costs. Gelegan gave them $14,000, although half was from an account other than his trust account, and he had advanced $2,000 for costs. The Client Security Fund paid the clients almost $19,000. Gelegan stipulated that he misappropriated $11,600 from the clients.

Gelegan received a settlement check but gave his client no money in another personal injury case. The clients received $32,500 from the Client Security Fund. Gelegan stipulated that he misappropriated at lest $24,250.

The final matter also was a personal injury case, and again Gelegan received a settlement check but gave his client no money, misappropriating $28,500 from her. Again the Client Security Fund paid out $33,333.

In mitigation, Gelegan had no prior record of discipline and he made restitution to two clients.
